Problem in filing ST-3 returns for the current per
Sub.: Problem in filing ST-3 returns for the current period, if by mistake assesses already filed returns for this period – Procedure for rectification. Instances have been reported by some field formations to this Directorate-General that some assesses had indvertently filed ST3 Returns online in ACES for a future period. As a result, when they tried filling the returns for the same period, when it was due, the system did not accept it as the returns for that period were already in the database. As per the earlier functionality in ACES, the system allowed filling of ST3 returns by choosing the period, from the drop menu (Apr-Sept or Oct-March) for a particular financial year, for which the return was required to be filed and there was no validation in the system to disallow choosing a future period. As a result, if an assesses wishing to file a return for six-month period of Apr-Sept, 2010, inadvertently selected Oct-March period from the drop-down menu, instead of disallowing the assesses to file return for this period (Oct-Mar), it permitted filing the return. Subsequently, when he tried to file the return for the period Oct-March, 2011, the system would not allow him to file. In order to prevent occurrence of this problem, modification has been carried out in ACES application and now assesses are not being allowed to file ST-3 Returns for any future period. It is, however, verified that around 1050 assesses have already filed such returns, some of which have approached the ACES Service Desk with a request to correct the period of return so as to enable them to file return for the current period. But since any such corrections by DG Systems, on the basis of direct request from the assesses may lead to legal dispute or revenue lost, and may, therefore, be misused, it has been decided that upon receipt of request from such assesses, the Commissionerate will verify the genuineness of the claim of the assesses for amendment of the period of return and if satisfied, will forward their recommendation to DG (Systems). Upon receipt of the specific recommendations from the Commissionerates for change of period of return, DGS will correct the return period at back-end to enable the asseesses to file the ST-3 Returns for the concerned period. You are therefore informed to get the requests, if any, from the assesses thoroughly examined before sending recommendations to DGS for correcting the return period through a back end process in ACES. This process may be circulated amongst your staff members and suitable trade notices may also be issued so that any assessee, facing this problem can approach your office for necessary action. FICCI ON COMBINATION REGULATIONS
New Delhi, May 11, 2011: FICCI welcomes CCI’s announcement on much awaited Combination Regulations that will now help in establishing a vibrant and forward looking competition practice India. The consultative process adopted by CCI in finalizing these regulations have indeed helped in taking care of several of Industry’s concerns. “We are delighted that most of the concerns and recommendations made by us find place in notified guidelines particularly the Schedule 1 that related to Exempted transactions which are not likely to cause appreciable adverse effect on competition in India. In particular FICCI also welcomes the clarification issued on transactions or mergers on which definitive action has commenced prior to 1 June 2011 and hence are outside the purview of the Commission, said Ms Vijaya Sampath, Co-chair, Corporate Law Committee of FICCI. Drastic reduction in fees from earlier proposal of Rs 10 – 40 lakhs to Rs. 50,000 – 10 lakh is a huge relief to the Industry. To speed up the clearance process, the days of approving transactions will now be computed with reference to calendar days as against proposal of calculating this period on working day basis. Similarly, Exempting foreign transactions taking place entirely outside India with insignificant local nexus comes as a huge relief and greater certainty to particularly foreign players who were extremely worried on this account. “However, the regulations still do not talk about pre merger consultation which is a global good practice. But FICCI is sure that given the flexibility with which CCI has worked with Industry, the regulator at some stage would find value in including this world wide practice”, said Ms Sampath.

Replacement of DEPB Scheme
The Union Government is considering to replace the Duty Entitlement Pass Book Scheme (DEPB) to reimburse input taxes paid by the exporters in view of the forthcoming GST and has asked the Empowered Committee of Finance Ministers to take up the issue of an alternative to DEPB. Since the GST will be a two tier system, reimbursement of input taxes, particularly at State level, needs to be tackled.


Study on ‘MSME Support Scheme having role for Asso
We wish to inform you that MSME associations and Business Membership Organizations (BMOs) are being increasingly partnered for design and implementation of MSME support programmes. A number of such MSME support schemes have been announced after 1991 by different Union Ministries, Government of India wherein Associations are expected to play a lead role. Whereas there has been some resistance in public policy set up towards such partnerships, evident from unrealistic conditions imposed in many of these schemes, the Associations themselves have not been fully geared up for taking up the new role. A Study commissioned by GTZ ( German Technical Cooperation)- under SME F&D Project, highlights some of these findings. A first of its kind, the study provides: a. Mapping of all MSME Support Schemes envisaging lead role by Associations (42 schemes) b. Detailed analysis of major public schemes (supply side) and the associations (demand side) c. Model steps for effective design and implementation of schemes and an institutional framework for Capacity Building of MSME associations In this regard, FISME has requested us for suggestions.
